1. General Terms and Conditions

These General Terms and Conditions (GTC) apply to all legal relations conducted via the Service Provider's website (mychowgar.com) and its subdomains.

2. Basic Provisions

For any matters not regulated by these GTC, the applicable Hungarian law, especially the Civil Code (Act V of 2013), shall govern the interpretation. All mandatory legal provisions apply without specific stipulation.

• Service Provider: The sole proprietor identified in Section 1 of this GTC.
• User: Any natural or legal person accessing the content of the Service Provider's online store, whether registered or not.

This GTC is effective from February 1, 2021, and remains in force until revoked. The Service Provider may unilaterally modify the GTC, with prior notification to Users on the website interface. Amendments take effect upon the User's first use of the online store following their entry into force.

The Service Provider does not adhere to any particular code of conduct. Contract language: Hungarian or English.

3. Registration, Subscription, Suspension, and Termination

3.1. By registering or purchasing on the website, the User declares to have read, understood, and accepted the GTC and the Data Management Notice, granting consent for data processing.

3.2. Users must provide accurate, personal data during purchase/registration. Any contract arising from false or third-party information is void.

3.5. All content is only available for online order, and prices displayed are gross prices in EUR.

3.10. Available Content: Training and instructional videos from beginner to master level, available through a modular system by "monthly subscription" or "package" (Lifetime Access).

3.11. Despite full payment, the content remains the property of the Service Provider. The User gains access to purchased content only for the duration they purchased.

3.12. User Usage Restrictions: The User may only use purchased content for personal use and is strictly prohibited from reselling, sharing with third parties, public screening, public use, or distribution. Each subscription is strictly linked to a single User.

3.13. Subscription Suspension: The User may request a one-time suspension of their "monthly" subscription for a maximum period of one (1) year. After this period, access to the "monthly" subscription and related content will expire. Access to "package" subscriptions (Lifetime Access) remains unaffected.

3.14. Expiration and Termination: If a User's "monthly" subscription expires and the User has not requested a suspension, the subscription will terminate. The User may terminate their subscription prior to its expiration by providing at least 15 days' notice to the Service Provider.

4. Order Process, Payment, and Delivery

4.1. Order Process: After registration, the User logs into the online store. Purchases cannot be made without registration. Registration is free.

4.2. Payment Methods: Payment is processed via Stripe (credit/debit card). The Service Provider does not store card details. All transactions are secured by TLS encryption.

4.3. Delivery: Digital content is made available immediately upon successful payment confirmation. Access is granted through the user's account on the platform.

4.4. Invoicing: Electronic invoices are issued automatically via Billingo in EUR, in compliance with Hungarian accounting law, and are available for download in the user's account.

5. Right of Withdrawal

In accordance with EU Directive 2011/83/EU and Hungarian Government Decree 45/2014 (II.26.), the right of withdrawal does not apply to digital content that has been made available with the User's prior explicit consent and acknowledgment that they thereby lose their right of withdrawal.

By completing a purchase, the User explicitly consents to the immediate provision of the digital content and acknowledges that they waive their right of withdrawal upon access being granted.

In cases where access has not yet been granted, the User may cancel their order within 14 days of purchase by contacting [email protected].

6. Liability

The Service Provider is not liable for any technical failures, interruptions, or data loss caused by circumstances beyond its control. The Service Provider makes reasonable efforts to ensure continuous availability of the platform but does not guarantee uninterrupted service.

The Service Provider is not liable for any damages arising from the User's use of the content in a manner inconsistent with these GTC.

7. Intellectual Property

All content on the platform — including but not limited to videos, images, text, training programs, and instructional materials — is the exclusive intellectual property of the Service Provider and/or its licensors. Unauthorized reproduction, distribution, or use is strictly prohibited and may result in legal action.

8. Dispute Resolution

In the event of a dispute, the parties shall first attempt to resolve it amicably. If no resolution is reached, Hungarian law shall govern, and the competent Hungarian courts shall have jurisdiction.

For consumer disputes, the User may also contact the relevant Hungarian conciliation body (Pest County Conciliation Body, 1119 Budapest, Etele út 59-61.).
