1. Introduction

Bereczki Zoltán, a sole proprietor (registered office: 2080 Pilisjászfalu, Rákóczi utca 2.) (hereinafter: Service Provider, Data Manager), as the operator of the MYCHOWGAR webshop, submits to the following prospectus and the 2011 CXII. Act on the Right of Informational Self-Determination and on Freedom of Information (hereinafter: Info Act), which is also marked as the legal basis for data processing, especially the Info Act § 5 (1) a), according to which personal data may be processed if it is ordered by law or — on the basis of the authorization of law, within the scope specified therein, in the case of data not classified as special data or criminal personal data — by a local government decree for public interest purposes.

2. Interpretive Concepts (§ 3)

  • Data subject / User: a natural person identified or identifiable on the basis of any information; legal person.
  • Personal data: any information about the data subject.
  • Special data: personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, as well as genetic data, biometric data for the unique identification of natural persons, health data and personal data concerning the sexual life or sexual orientation of natural persons.
  • Controller: any natural or legal person, or any entity without legal personality, who, independently or in association with others, determines the purposes for which the data are processed.
  • Data management: any operation or set of operations on data, irrespective of the procedure used, including in particular the collection, recording, systematisation, storage, modification, use, interrogation, disclosure, coordination or aggregation, blocking, erasure and destruction of data.
  • Data protection incident: a breach of data security which results in the accidental or unlawful destruction, loss, alteration, unauthorized transfer or disclosure of, or unauthorized access to, personal data.

3. Principles (§ 4 of the Info Act)

Personal data may only be processed for a clearly defined, legitimate purpose, in order to exercise a right and fulfil an obligation. At all stages of data processing, the purpose of data processing must be appropriate, and the collection and handling of data must be fair and lawful.

Only personal data that is essential for the purpose of data processing and suitable for that purpose may be processed. Personal data may only be processed to the extent and for the time necessary to achieve the purpose.

Adequate security of personal data shall be ensured through the use of appropriate technical or organizational measures to protect personal data, in particular against unauthorized or unlawful processing, accidental loss, destruction or damage.

4. Legal Basis and General Conditions of Data Processing (§ 5)

Personal data can be processed if:

  • it is ordered by law or, in the case of data which does not qualify as special data or criminal personal data, by a law of a local authority pursuant to the authority specified by law, for a purpose based on the public interest,
  • in the absence of the provisions of point a), it is absolutely necessary for the performance of the data controller's tasks specified by law and the data subject has expressly consented to the processing of personal data,
  • necessary and proportionate to protect the vital interests of the person concerned or of another person and to avert or prevent an imminent threat to the life, limb or property of the person concerned, or
  • the personal data have been explicitly disclosed by the data subject and are necessary and proportionate to the purpose of the processing.

5. Rights of the User (§ 14 of the Info Act)

The data subject (the user) is entitled to:

  • be informed of the facts relating to the processing prior to the commencement of the processing (right of prior consultation);
  • upon request, provide the controller with personal data and information related to their processing (right of access);
  • have personal data corrected or supplemented (right to rectification);
  • have the processing of personal data restricted (right to restrict data processing);
  • upon request, have personal data deleted (right to delete).

6. Data Processed During Registration and Purchase

During registration and purchase, the following data is collected: name, email address, billing address, tax ID (for legal entities), telephone number, and transaction details.

The legal basis for processing is the voluntary consent of the data subject. Data is retained for the duration of the contractual relationship and as required by applicable accounting and tax law.

10. Data Deletion

Data associated with completed orders will be retained as required by applicable law (generally 5–8 years for accounting records). All other data will be permanently deleted upon request.

The Service Provider implements appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, destruction, or accidental loss. Data is transmitted over encrypted connections (HTTPS/TLS).
